Terms of Service
These Terms of Service ("Terms") govern your use of TorontoEats Inc.'s event staffing services and website located at torontoeats.ca. By submitting a staffing request, booking our services, or using our website, you agree to these Terms. Please read them carefully.
1. About TorontoEats
TorontoEats Inc. is a Toronto-based event staffing operator that supplies vetted culinary and hospitality professionals — including chefs, cooks, servers, and bartenders — to clients hosting events across the Greater Toronto Area and surrounding regions. We act as the employer of record for all staff we supply.
2. Services
TorontoEats provides managed event staffing services, which include:
- Sourcing and assigning qualified staff to your event based on your requirements
- Coordinating staff schedules, briefings, and attendance
- Acting as the single point of contact for all staffing-related matters
- Following up after your event to collect feedback
We do not provide food, catering supplies, equipment, or venue services unless explicitly agreed in writing.
3. Booking Process
Inquiry and quote
Submitting a staffing request through our website or by phone does not constitute a binding agreement. We will review your request and send you a staffing plan and pricing within 2 business hours during normal operating hours (Monday–Friday, 8 AM–8 PM ET; weekends and statutory holidays may have extended response times).
Confirmation
A booking is confirmed only when you have reviewed and approved the staffing plan in writing (including by email) and we have confirmed availability. No commitment is made by either party until both steps are complete.
Changes to confirmed bookings
Requests to change the date, time, location, or number of staff for a confirmed booking must be made in writing at least 5 business days before the event. We will accommodate changes subject to staff availability. Material changes may affect pricing.
4. Rates and Payment
Hourly rates
Staffing is billed at the hourly rates specified in your confirmed staffing plan. Current standard rates are:
- Chef / Sous Chef: $55–70/hr per person
- Line Cook: $35–45/hr per person
- Server: $28–35/hr per person
- Bartender: $38–48/hr per person
Exact rates depend on experience tier, event complexity, and booking lead time. Rates quoted in your staffing plan are binding for that booking.
Minimum booking hours
- 4-hour minimum applies to all bookings within the Greater Toronto Area.
- 5-hour minimum applies to all bookings outside the GTA.
Travel time — out-of-GTA events
For events outside the Greater Toronto Area, travel time is billed at each staff member's hourly rate, calculated portal-to-portal (from the staff member's location in the GTA to your event venue and return). Travel costs will be disclosed and agreed in writing before your booking is confirmed.
A distance surcharge may apply for events more than 100 km from downtown Toronto. This will be itemized in your quote.
Rush booking surcharge
Bookings confirmed with fewer than 48 hours' notice are subject to a rush surcharge of 20%–50% of the base staffing cost, depending on availability and timing. Rush bookings are subject to staff availability and cannot always be accommodated.
Invoicing and payment
Invoices are issued following completion of each event. Payment is due within 14 days of the invoice date unless otherwise agreed in writing. For recurring clients or accounts, monthly invoicing terms may be available — contact us to discuss.
Overdue invoices are subject to interest at 1.5% per month (18% per annum) on the outstanding balance.
5. Cancellation Policy

Cancellation fees reflect staff commitments and costs incurred in preparing for your event. Cancellations must be communicated in writing to .
Force majeure
If your event is cancelled due to circumstances beyond your reasonable control (including severe weather, declared public health emergencies, or government-ordered venue closures), we will waive the cancellation fee for a rescheduled date within 90 days, subject to availability.
6. Our Staff
Employment status
All staff supplied by TorontoEats are employees or contractors of TorontoEats Inc. You do not have an employment relationship with any staff member we supply. Do not ask our staff to perform work outside the scope of the agreed staffing plan.
Conduct and performance
We maintain a tiered network of staff. We take conduct and performance seriously and review feedback after every event. If you are dissatisfied with a staff member's performance during an event, notify your coordinator immediately so we can address it.
Staff replacement
If a confirmed staff member is unable to attend your event, we will make reasonable efforts to provide a qualified replacement of equal or greater experience tier. If we are unable to provide a replacement, you will not be charged for that position.
Direct engagement prohibition
You agree not to directly engage, hire, or solicit any TorontoEats staff member for independent work during the term of any active booking and for a period of 12 months following the conclusion of any event we staffed for you, without our prior written consent. A referral fee may apply if consent is granted.
7. Client Responsibilities
You agree to:
- Provide accurate event details when submitting your request
- Ensure a safe working environment for our staff in compliance with Ontario's Occupational Health and Safety Act
- Provide any access, parking, or materials required for staff to perform their duties
- Notify us promptly of any changes to your event that may affect staffing requirements
- Not ask our staff to perform tasks outside the scope of their assigned role without our prior agreement
- Not supply alcohol to our staff during a shift
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- TorontoEats' total liability to you for any claim arising from our services is limited to the amount you paid for the specific event giving rise to the claim.
- TorontoEats is not liable for any indirect, incidental, special, or consequential damages, including lost revenue, reputational harm, or costs of substitute services.
- We are not responsible for property damage caused by clients, their guests, or third-party vendors at the event.
Nothing in these Terms limits liability for gross negligence, fraud, or death or personal injury caused by our negligence.
9. Intellectual Property
All content on torontoeats.ca — including text, design, logos, and software — is owned by TorontoEats Inc. or licensed to us. You may not reproduce, distribute, or create derivative works from our content without our written permission.
10. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute that cannot be resolved through good-faith negotiation will be submitted to binding arbitration in Toronto, Ontario under the rules of the ADR Institute of Canada, unless you elect to bring a claim in Small Claims Court.
11. Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page will be updated when changes are made. For active bookings, the Terms in effect at the time of booking confirmation apply. For new bookings, the current Terms apply.
